Terms of Use

1. General

hagaid.com is operated by Hagai Davidoff, a registered sole proprietor in Israel (business number 033761586), referred to below as "the Operator". These terms govern the relationship between the Operator and anyone who browses the site or purchases a service through it, referred to below as "the User".

Browsing the site or purchasing through it constitutes full acceptance of these terms. If you do not agree to them, please do not use the site.

2. What is sold on this site

The site sells three kinds of products and services:

Digital courses in music production, mixing, and sound. The courses are online and self-paced. There are no start dates and no cohorts, you can enroll at any time, and the content is delivered through the member area on the site.

Digital products for download: audio software plug-ins, products for the Kontakt player, sheet music files, and digital books. These are delivered as a downloadable file, and some of them require license activation.

Private lessons by prior arrangement.

The site also publishes free content such as articles and videos.

3. Enrollment and payment

Purchases are made through the site using secure payment processing. Prices shown on the site are in Israeli new shekels and include VAT as required by law. Billing is in shekels.

Once payment is complete, a tax invoice and receipt are sent to the email address given at checkout, and course access opens.

The Operator may update prices at any time. A price change does not apply to a purchase already made.

4. Cancellation and refunds

Digital courses: a full refund within 14 days of purchase, with no explanation required and no bureaucracy. This is our commitment, and it is broader than the legal minimum. To claim it, email hagai@hagaid.com within 14 days of your purchase. The refund is issued to the payment method used for the purchase, and course access is closed. After that period, refunds are not given, except where the law requires otherwise.

Digital products for download (software plug-ins, Kontakt products, sheet music, and books): a file that has already been downloaded cannot be returned, so refunds on these are limited. A full refund is given within 14 days of purchase provided the file has not yet been downloaded and the license has not yet been activated. Once the file has been downloaded or the license activated, no refund is given.

A faulty product, or one that does not work: always. If what you bought does not work as described, contact us and we will fix it. If we cannot, you get a full refund, even if the file has already been downloaded and the license already activated. We do not hide behind the refund limit when the fault is ours.

Private lessons: may be canceled up to 24 hours before the scheduled time. A later cancellation, or a no-show, is charged in full.

Nothing in this section limits the User's rights under the Israeli Consumer Protection Law, 1981, and the regulations made under it.

5. License to use the content and products

Course content. Purchasing a course grants a personal, private, non-transferable license to view that course's content. You may not copy, record, download, share, distribute, broadcast, sell, rent, upload, or pass the content on to any other person, and you may not share your account login details with anyone.

Software plug-ins and Kontakt products. Purchase grants a personal single-user license. The license is tied to the email address given at purchase and may not be transferred, sold, lent, or shared. You may install the software on up to three of your own personal computers, for your own use only. You may not distribute the installer, share your license key, or attempt to circumvent the activation mechanism.

Using products for the Kontakt player requires you to own a suitable version of Native Instruments Kontakt. It is not included in the purchase, and checking the system requirements before buying is the buyer's responsibility.

Sheet music and digital books. These files are for personal use, study, and performance. They may not be photocopied, duplicated, distributed, or resold. Commercial use, including publication, commercial recording, or use in institutional teaching, requires prior written permission.

At activation, which happens once and only once, the plug-in also sends technical details about the environment it runs in: the operating system, the music software (DAW) hosting it, the plug-in format, and the plug-in version. We use this to see which setups Spectdrum is actually running on, so we can test it there before every update. It is a snapshot of that single moment. The plug-in does not track how you use it, sends nothing further after activation, and never collects any information about the music or other content you create.

Breach. Breaching this section is a fundamental breach of these terms and an infringement of copyright. In that case the Operator may revoke the license and close access to the product immediately, without a refund, and pursue any legal remedy available.

6. Intellectual property

All rights in the site's content and in the course content, including text, video, recordings, audio files, exercises, designs, logos, and learning materials, belong to the Operator or to whoever licensed them to the Operator, and are protected by copyright law.

No commercial use may be made of them without prior written permission.

7. Liability

Course content is intended for learning and professional development. The Operator invests heavily in the quality and accuracy of the material but does not guarantee any particular commercial, professional, or artistic result for the User, since the outcome also depends on the User's own effort, equipment, and circumstances.

Use of third-party software and equipment mentioned in the courses is the User's responsibility and is subject to those manufacturers' own terms.

The Operator makes every reasonable effort to keep the site available but is not responsible for faults caused by infrastructure providers, by the internet itself, or by events beyond our control. In the event of a prolonged fault on our side, we will compensate the User by extending access or issuing a proportionate refund.

8. Changes to the service and to these terms

The Operator may update, improve, or add to course content, and may update these terms. The binding version is the one published on the site, and the date at the top will change accordingly. Continuing to use the site after an update means you accept the new version.

9. Privacy

10. Governing law and jurisdiction

These terms and anything arising from them are governed exclusively by the laws of the State of Israel. Exclusive jurisdiction rests with the competent courts of the Central District.
